1. Agreement to Terms

By accessing or using CapitalStatement (the "Service"), a product of Atkins Media AI & Software Solutions ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. Questions? Contact us at support@atkins-media.com.

2. Description of Service

CapitalStatement provides AI-powered bank statement extraction, transaction categorization, underwriting analysis, and lender report generation using GPT-4o Vision and Gemini 2.5 Flash.

Not Financial or Legal Advice: All reports and scores are for informational purposes only. They do not constitute financial advice, legal advice, credit decisions, or lending recommendations. You bear sole responsibility for any decisions made using this Service.

3. Eligibility

You must be at least 18 years old and have the legal authority to enter into this agreement. The Service is intended for business and professional use.

4. User Accounts

You are responsible for maintaining the confidentiality of your login credentials, all activity that occurs under your account, and notifying us promptly of any unauthorized use at support@atkins-media.com. We reserve the right to suspend accounts that violate these Terms.

5. Credits, Subscriptions & Payments

All fees are stated in US dollars and are non-refundable except as required by law or at our sole discretion.

Credits: One credit entitles you to one analysis run. Credits do not expire and are non-transferable.
Subscriptions: Subscription plans include a fixed number of credits per billing period. Unused credits do not roll over unless explicitly stated.
Payment Processing: Payments are processed by Stripe. By providing payment information, you authorize us to charge your payment method for applicable fees.
Price Changes: We reserve the right to change pricing with 30 days' notice to existing subscribers.

6. Acceptable Use

You agree not to use the Service to:

Upload documents containing data you do not have the legal right to process
Engage in fraud, money laundering, or any illegal activity
Reverse engineer or scrape the underlying AI models or algorithms
Circumvent usage limits, credit systems, or access controls
Upload malicious code or content intended to damage the Service
Resell access to the Service without our written consent
Process data of individuals without obtaining legally required consents

7. Uploaded Content & Data

You retain all ownership rights to the documents you upload. By uploading documents, you grant us a limited, temporary license to process them solely for the purpose of delivering the Service. We do not use your uploaded content to train AI models.

You represent and warrant that you have the legal right to upload and process all documents submitted to the Service.

8. Intellectual Property

All software, design, branding, and content comprising CapitalStatement — excluding your uploaded content — is owned by or licensed to Atkins Media AI & Software Solutions. You may not copy, reproduce, or create derivative works from any part of the Service without our written permission.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED OUTPUTS WILL BE ACCURATE OR COMPLETE. You should independently verify all outputs before relying on them for any business or lending decision.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ATKINS MEDIA AI & SOFTWARE SOLUTIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED AMOUNTS PAID BY YOU IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Atkins Media AI & Software Solutions and its officers, directors, employees, and agents from any claims arising out of your violation of these Terms or your use of the Service.

12. Termination

We may suspend or terminate your access at any time, with or without cause or notice, including for violation of these Terms. Credits remaining at termination for cause are non-refundable.

13. Governing Law

These Terms shall be governed by the laws of the United States, without regard to conflict of law provisions. Disputes shall be resolved through binding arbitration or a court of competent jurisdiction.

14. Changes to Terms

We reserve the right to update these Terms at any time. Material changes will be communicated via email or a notice on the Service. Continued use after changes become effective constitutes acceptance.
